HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3070 of 2016 ORDER:

1. This Criminal Petition is filed by the petitioner-accused No.2 seeking to quash the proceedings against him in C.C.No.1752 of 2015 on the file of the VI Metropolitan Magistrate, Medchal, Cyberabad.

2. It is alleged that the petitioner, who is working as driver of the crime vehicle belonging to A1, was found transporting the dismantled heavy vehicle parts. It is further alleged that the petitioner did not give reasonable account for transporting the said heavy vehicle parts to foundry for melting. Thus, he committed the offence punishable under Sections 41(b) and 102 Cr.P.C., Section 411 IPC and Sections 113 r/w 194 of the M.V. Act.

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case and the allegations made in the charge sheet against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.
