Ashwini Travel Agency, v. State Bank Of India, Stressed Assets Management Branch-Ii,
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Ms. JUSTICE J. UMA DEVI WRIT PETITION No. 28950 of 2017 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The action of the respondents, in putting 10 flats to sale by issuing e-auction sale notice dated 15.07.2017, is under challenge in this writ petition.
Sri Ambadipudi Satyanarayana, learned Standing Counsel for the first respondent Bank, on instructions, states that the e-auction notice dated 15.07.2017, wherein the date of auction was prescribed as 25.08.2017 was of no avail as, in the auction held on 25.08.2017, no bidder came forward to submit their bids; and the first respondent would issue an e-auction notice inviting bids afresh in accordance with law.
Leaving it open to the petitioner to avail his legal remedies, in case the first respondent issues an e-auction notice afresh, the writ petition is dismissed as infructuous.
Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) _________________ (J. UMA DEVI, J) Date: 30.08.2017 va
