HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1274 of 2019 ORDER:

This petition is filed under Section 397 read with Section 401 Cr.P.C., by the petitioner/owner of vehicle, aggrieved by the order dated 30.09.2019 passed in Crl.M.P.No.2442 of 2019 in Cr.No.369 of 2019 by the learned XI Additional Chief Metropolitan Magistrate, Secunderabad.

By the order impugned, the learned Magistrate directed to return the property i.e., Splendor Plus bearing No.AP 28 AR 8871, to the petitioner for interim custody, on his executing a personal bond for a sum of Rs.60,000/- with one surety for the like sum. 3.

Learned counsel for the petitioner contended that as the petitioner is a daily wage earner, he is unable to furnish such huge amount of personal bond and surety and therefore, he seeks to modify the said order by reducing the said amount. 4.

The petitioner is owner of the subject vehicle and if the vehicle is kept idle for a long period, there is every possibility of it getting damaged. Therefore, ends of justice would be met, if the amount of personal bond and surety is reduced from Rs.60,000/- to Rs.30,000/-.

Accordingly, the Criminal Petition is disposed of, with a direction to the petitioner/owner of vehicle to furnish a personal bond

GSD,J Crl.P.No.1274 of 2019 for a sum of Rs.30,000/- (Rupees thirty thousand) with one surety for a like sum to the satisfaction of the concerned Court. 6.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
