HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36623 OF 2015 ORDER:

Heard learned counsel for the petitioners and Sri Sajja Rama Suryam, learned counsel for the first respondent. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the first respondent in not considering and disposing of the representation dated 07.09.2015 made by the petitioners in the light of recommendation of the second respondent as illegal and arbitrary.

Learned counsel for the petitioners submits that though the husband of the petitioner, who is ex-service man, constructed a shed and running the mechanic shed in the land in question, 70% of the land was taken away. It is his case that some vacant land admeasuring about 400 square yards is lying behind the land in question and it would be appropriate if the same is allotted to the petitioners.

Without going into merits of the case and having regard to the circumstances stated above, the present Writ Petition is disposed of directing the first respondent to consider the representation dated 07.09.2015 made by he petitioners seeking vacant land lying behind the land allotted earlier to the petitioners, in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of the order, if the same is still pending consideration. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
