THE HON'BLE SRI JUSTI CE M.S.K. JAI SWAL WRI T PETI TI ON No.9292 of 2009 ORDER:

This writ petition is filed for a mandamus, declaring the action of the respondent in not supplying the commodities to the petitioner's fair price shop No.5602, Korlakunta (Medaram) village, Mahamutharam Mandal, Karimnagar District, even though the authorization of the petitioner's shop is subsisting and not cancelled, as illegal and arbitrary, and consequently direct the respondent not to stop and continue the supply of the commodities to the fair price shop of the petitioner. Heard the learned counsel for the petitioner as well as the learned Government Pleader for Civil Supplies.

The grievance of the petitioner is that pending enquiry under Section 6A of the Essential Commodities Act, 1955, which was initiated for suspension or cancellation of the fair price shop, the supply of stocks were suspended and hence the writ petition was filed. This Court, vide orders, dated 29.04.2009, directed that the respondent shall continue to supply the commodities to the shop of the petitioner, provided the authorization of the petitioner is neither suspended nor cancelled.

It is submitted that even till date the authorization of the petitioner is neither suspended nor cancelled. Therefore, the Writ Petition is disposed of, directing that there should not be any disruption in the supply of commodities to the fair price shop of the petitioner so long as the authorization of the petitioner subsists. No order as to costs.

MSKJ, J W.P.No.9292 of 2009 Pending miscellaneous petitions, if any, shall stand closed in consequence.
