Heard learned counsel for petitioners, learned Assistant Government Pleader for Revenue appearing for respondent Nos 1 to 4 and Sri Aare Venkateshwara Rao, learned counsel for respondent No.5.

These writ petitions are filed challenging the orders of the Special Tribunal, Khammam District passed separately in individual cases without following due process. Parties in all the cases are same.

The primary challenge to the order of the Special Tribunal is that petitioners were not afforded opportunity of hearing before passing orders. Both counsel agreed for setting aside the orders of Special Tribunal and remanding the matters to Special Tribunal for consideration of the issue afresh.

Accordingly, writ petitions are allowed. The impugned orders of the Special Tribunal are set aside. The matters are remanded to the 2nd respondent-the Special Tribunal, Khammam District. The Special Tribunal is directed to issue notice to the parties before the Special Tribunal by fixing date of hearing and afford opportunity of hearing and on due consideration of respective submissions, pass orders by assigning reasons in support of decision.
