HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.373 OF 2018 ORDER:
Heard the learned counsel for the petitioner. This revision is filed aggrieved by the order dated 5-1-2018 in Crl.M.P.No.30 of 2018 in Crl.A.No.3 of 2018 on the file of Metropolitan Sessions Judge, Hyderabad whereunder the learned Judge while allowing the petition directed to deposit half of the cheque amount on or before 6th February, 2018. The submission of learned counsel for the petitioner is that now the petitioner is jobless and hard-pressed for money and in these circumstances, the condition imposed by the lower appellate court to deposit half of the cheque amount i.e.,Rs.3,00,000/- by 6th February, 2018 is beyond his capacity and therefore, the condition may be modified.
The cause title in the order reads that petitioner/accused is a business man. No material is placed before this court to hold that he is now jobless. Therefore, this court is not inclined to reduce the amount ordered to be deposited by the Court. However, considering the fact that time for deposit is over, this court is inclined to only extend the time.
Accordingly, the time granted by the lower appellate court to deposit the amount is extended upto 2nd May, 2018 on or before which the petitioner has to deposit the amount as directed by the lower appellate court. On such deposit, respondent/complainant is permitted to withdraw the same by offering suitable 3rd party property security to the satisfaction of the trial court.
Accordingly, this Criminal Revision Case is disposed of.
As a sequel, miscellaneous applications pending if any, shall stand closed.
