The case of the petitioners is that the petitioners filed appeal/revision against the order dated 15-02-2016 in case No.B/1641/2012 before the Joint Collector-3rd respondent under Section 9 of A.P.Rights in Land and Pattadar Passbooks Act along with stay petition. But after bifurcation of the districts, the same was transferred to Joint Collector, Nirmal District and the officer while acting as Revenue Divisional Officer (R.D.O.) passed impugned orders in the revision who is posted as Joint Collector, Nirmal and as he cannot entertain the revision against his own order, the revision has not been taken-up and no orders are passed in the stay petition. Meanwhile, the 3rd respondent is trying to implement the orders passed by the 4th respondent. Aggrieved by the same, the present writ petition is filed.
Heard learned counsel for the petitioners.
Learned Assistant Government Pleader for Revenue submits that the 2nd respondent can either entertain the revision himself or transfer the revision from the Joint Collector, Nirmal to any other officer, since the order is passed by the Joint Collector, Nirmal while he was functioning as R.D.O.
In view of the above facts and circumstances of the case, since it is also stated that pattadar passbooks were granted in the year 1990 after regularization of sale deeds in favour of the petitioners, the 2nd respondent is directed to dispose of the stay petition/revision or he can transfer the same to any competent officer and if the revision is transferred, the said authority shall dispose of the stay petition/revision within a period of three months from the date of receipt of a copy of this order. Till passing of order in the stay petition or the appeal, the impugned order dated 15-02-2016 in case No.B/1641/2012 is suspended. Accordingly, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 20-04-2017 Nvl
