This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.1 & A.2, seeking to quash the proceedings in Crime No.3 of 2018 on the file of the Guntakal I Town Police Station, Anantapuramu District, registered for the offences under Sections 323, 506 read with 34 of I.P.C. and Section 3(i)(r)(s) of SCs & STs (POA) Act, 1989.

Heard the learned counsel for the petitioners/ A.1 and A.2, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

The learned counsel for the petitioners/ A.1 and A.2 submitted that as per the report lodged with the police on 03.01.2018, the alleged offences said to have taken place within the four corners of the house. Further, it is urged before this Court that as per the report lodged with the police, the alleged offence took place on 17.08.2017, but the report was lodged with the police on 03.01.2018. The allegations require examination. The petitioners/ A.1 and A.2 are husband and wife. Having regard to the facts and circumstances of the case, this Court deems it appropriate to direct the Station House Officer concerned to not to arrest the petitioners/ A.1 and A.2 pending investigation and complete the investigation with regard to the
innocence or otherwise of the petitionrs/ A.1 and A.2 and file final report or charge-sheet, as the case may be.

With the above direction, this Criminal Petition is disposed of.
