THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4975 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed challenging the order dated 08.01.2015, the effect of which is reversion of the petitioners' status. The order itself shows undoubtedly that the petitioners have faced civil and evil consequences. Before passing the impugned order, no opportunity of being heard was given to the petitioners. Under the circumstances, we feel that for compliance of natural justice, following course of action may be taken. The order impugned shall be kept in abeyance until a fresh decision is taken in terms of this order.
We therefore direct the learned District Judge to give a notice of hearing to the petitioners and on receipt thereof, if the petitioners appear before him, he shall consider their contention and thereafter pass appropriate orders without being influenced or swayed by the impugned order. In the process, it would be open for him either to withdraw or to retain the order. The entire exercise shall be completed within a period of one month from the date of communication of this order.
