HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.4746 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " ..... to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not disposing the appeal dt.15.03.2016 of the petitioner for revision of seniority list in the cadre of Assistant Geologist is highly illegal, arbitrary, unjust, violation of principles of natural justice and contrary to the Rules made thereunder and consequently direct the respondents to consider/ dispose the appeal dt.15.03.2016 of the petitioner for revision of seniority list in the cadre of Assistant Geologist as per CCA Rules ....." .

Heard Mr.P.Pradeep Kumar Reddy, learned counsel for petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he is working as Assistant Geologist and he is fully eligible and qualified to be promoted to the post of Assistant Director of Mines and Geology. The grievance of petitioner is that the respondents have erroneously prepared the seniority list among the direct rectruites and promotees. Aggrieved by the same, the petitioner has preferred appeal before the appellate authority on 15.03.2016. The appellate authority is neither disposing of appeal nor revising the seniority list as per Rules. Therefore, the learned counsel for petitioner contends that appropriate orders be passed in the writ petition directing the respondents to dispose of the appeal preferred by the petitioner on 15.03.2016 and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for respondents has contended that the appellate authority will dispose of the appeal preferred by the petitioner within a reasonable period of time. This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the appellate authority to dispose of the appeal preferred by the petitioner on 15.03.2016, if not already disposed of, within a period of six weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
