THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8006 OF 2016 ORDER:

This petition is filed by the petitioners-Accused under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.72 of 2016 on the file of II-Town Police Station, Ongole, Prakasham District, registered for the offences punishable under Sections 3(1)(r)(s), 3(2)(v) of SCs & STs (POA) Act, 1989 and 506 and 509 r/w.34 IPC. The allegation against the petitioners is that they abused the de facto complainant and his family members in the name of their caste since they are living in a rented house near the house of the petitioners.

Learned counsel for the petitioners submitted that the petitioners is innocent of the offences alleged against them and due to the civil disputes between the house owner of the de facto complainant and the petitioners, they were implicated in the present case with false allegations.

The learned Additional Public Prosecutor submitted that in view of bar under the provisions of the SC & ST Act, this petition is not maintainable.

Considering the facts and circumstances of the case and in view of the submissions made by the learned Additional Public Prosecutor, this Court is of the view that this petition is not maintainable.

Accordingly, the Criminal petition is dismissed. ______________ RAJA ELANGO, J June 16, 2016.
