CVNR, J & GSP, J WA 880/2017 ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ appeal is filed against order dt.20.4.2017 in Writ Petition No.3964 of 2006, confirming order dt.31.5.2003 passed by the Central Government Industrial Tribunal -cum- Labour Court (for short, "the Tribunal"), Hyderabad, in L.C.I.D. No.85 of 2002. At the hearing, Mr. A.K. Jayaprakash Rao, learned counsel for the appellant, submitted that his client will be satisfied if respondent No.4, which is stated to have been taken over by the Kotak Mahindra Bank, and respondent No.5 - Branch Manager of the said Bank are directed to implement the direction of the Tribunal, contained in its Award, which reads as under:
"...However, the respondent No.2 is directed that in future if any causal or temporary peon is appointed the petitioner shall be given preference over other juniors taking his initial date of appointment as 20.11.2000." In view of the aforesaid submission of the learned counsel for the appellant, the writ appeal is disposed of directing respondent Nos.4 and 5 to consider the case of the appellant to engage him as casual or temporary peon by giving preference to him over other juniors, if any, appointed during the interregnum between the passing of the Award and today.
As a sequel to disposal of the writ appeal, W.A.M.P. No.1723 of 2017 shall stand disposed of as infructuous.
