HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.9850 OF 2009 ORDER:
The petitioners apprehension, as expressed in the affidavit filed in support of the Writ Petition, is that the respondents were interfering with their possession of the land in Sy. No.376 of Attapur village, Rajendranagar, Mandal. In the counter-affidavit filed by the Tahsildar it is stated that the land in Sy. No.376, admeasuring Ac.13.10 gts and classified as patta lands, stands in the name of the petitioners; adjacent to the said patta land is the land covered by a grave yard; as the petitioners sons were seeking to level the land in the grave yard with a JCB illegally, the respondents had taken steps to protect the grave yard from encroachment; and they are not interfering with the petitioners possession over their patta lands.
As it is now stated that the respondents are not interfering with the possession of the petitioner over their patta lands, suffice it to dispose of the Writ Petition directing the respondents not to interfere with the petitioners possession of their patta lands. The respondents shall, however, take all such steps as are necessary to prevent any encroachment into the adjacent grave yard either by the petitioner or anybody else. The Writ Petition stand disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs. _________________________________ RAMESH RANGANATHAN, ACJ Date: 11.08.2017.
