THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13511 of 2013 ORDER:

This Criminal Petition is filed by the petitioners-A1 and A2 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.768 of 2013 on the file of the XI Additional Chief Metropolitan Magistrate, Secunderabad.

The petitioners are alleged to have committed the offence punishable under Sections 417 IPC and Section 14 of Foreigners Act. Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to quash the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioners has not pressed for the relief sought for in this petition and he prayed to dispense with the presence of the petitioners before the trial Court and to expedite hearing of the above C.C.

Accordingly, the Criminal Petition is dismissed. However, the presence of the petitioners before the trial Court is dispensed with, except on the dates when the trial Court insists for their presence.
