This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused to quash the proceedings in Crime No.700 of 2018 of KPHB Colony Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 509, 506 & 290 of IPC. 2 .
Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the 1st respondentState and perused the record. 3 .
There is specific mention of harassment and defamation through Whatsapp messages and text massages through mobile phone etc., against the petitioner/ accused. There are also other allegations constituting offences punishable under Section 509, 506 & 290 of IPC against the petitioner/ accused. Therefore, it cannot be said that there are no grounds to quash the proceedings against the petitioner/ accused in the subject crime and continuation of proceedings would amount to abuse of process of the Court. The Criminal Petition does not merit consideration and is liable to be dismissed.
