ORDER:

This writ petition is filed for a mandamus to set aside auction notice, dated 02.02.2012, wherein the extents of Acs.3.95 cents and Ac.1.00 of land situated in Survey Nos.98/C and 694/2 of Nuthakkivarikandrika Village, Chejerla Mandal, SPSR Nellore District belonging to the petitioner were sought to be sold for recovery of the amounts allegedly due by him under surcharge orders.

By conditional interim order, dated 14.03.2012, this Court has stayed the auction.

Sri Ch.C.Krishna Reddy, learned counsel for the petitioner, submitted that when this writ petition was filed, the OAs filed by the petitioner against the surcharge orders were pending before the A.P.Cooperative Tribunal and that during the pendency of this writ petition, the said OAs were dismissed and feeling aggrieved by the said order, the petitioner has filed W.P.Nos.5108, 5159 & 5116 of 2014, wherein this Court has granted interim orders.

Inasmuch as the auction notice was issued pending OAs and the OAs were subsequently dismissed, the cause in the writ petition does not survive for adjudication. The writ petition is accordingly dismissed, however, with liberty to the petitioner to pursue W.P.Nos.5108, 5159 & 5116 of 2014 stated to be pending in this Court.

As a sequel to dismissal of the writ petition, interim order, dated 14.03.2012, shall stand vacated and W.P.M.P.No.8820 of 2012 shall stand disposed of as infructuous.
