THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21225 of 2016 ORDER:

The petitioner is the fair price shop dealer of shop No. 9, Nayakallu Village, Kallur Mandal, Kurnool District. His authorization was suspended pending inquiry, vide proceedings, dated 26.05.2016 of the 4th respondent Revenue Divisional Officer, Kurnool, mainly on the allegations that he has been resorting to diversion of essential commodities to the open market and that he has not been residing in the village concerned. It is this order which has been challenged in this Writ Petition.

Heard learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies (Andhra Pradesh). It is stated that against the order of suspension dated 26.05.2016, the petitioner has already filed the statutory Appeal before the 3rd respondent Joint Collector, Kurnool on 17.06.2016. The truth or otherwise of the charges framed against the petitioner can be inquired into in the said Appeal.

Hence, this Writ Petition is disposed of directing the 3rd respondent Joint Collector to deal with the Appeal dated 17.06.2016 preferred by the petitioner in accordance with law and pass appropriate final orders thereon, within a period of two weeks from the date of receipt of a copy of this order. Till then, the order dated 26.05.2016 shall stand suspended. No costs.

Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
