HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5259 of 2019 ORDER:

The prayer of the petitioners in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 4th respondent in not issuing of pattadar pass books and title deeds in respect of the lands in Sy.No.628 to an extent of Acs.3.06 cents situated at Phanigiri Village, Nagaram Rural Mandal, Suryapet District, by considering the report of 5th respondent dt 27.07.2017 as illegal, arbitrary and contrary to the Rights in Lands of Pattadar Pass Books Act, 1971, and consequently direct the respondents to issue pattadar pass books and title deeds in respect of the above stated lands in favour of the petitioners forthwith and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioners made an application in the prescribed format in Form VIA under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The endorsement made on the said application reflects that the office of the Tahsildar, Nagaram Rural Mandal, Suryapet District, received the same on 12.01.2019.

Having received such an application, it is not open to the Tahsildar, Nagaram Rural Mandal, Suryapet District, to remain somnolent.

The Writ Petition is accordingly disposed of directing the Tahsildar, Nagaram Rural Mandal, Suryapet District, to take appropriate action upon the petitioners' application in Form VIA in accordance with the due procedure expeditiously and in any event,

SK, J WP.No.5259 of 2019 Dt:14.3.2019 not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
