THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.17764 of 2014 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
" ...it is therefore prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent herein with regard to not initiating action in pursuant to representation dt.24.3.2014 whereunder the writ petitioner is seeking appointment as shift operator in the existing vacancies by declaring the inaction as illegal, arbitrary and violative of rights guaranteed under Articles 14,16, 21 and 300-A of the Constitution of India and pass such other order or orders as this Hon'ble Court may deem think fit and proper in the circumstances of the case."
Heard Sri V. Mallik, learned counsel for the petitioner and Smt.
J. Koteshwari Devi, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 24-32014 to the 1st respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 1st respondent to pass appropriate orders on the representation, dated 24-3-2014, in accordance with law, by fixing some time frame. The said request is not opposed by learned Standing Counsel for respondents and submitted that the said representation would be considered, in accordance with law.
For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 1st respondent to consider and pass appropriate orders on the representation, dated 24-3-2014 said to have been submitted by the petitioner herein, in accordance with law, within a period of two
(2) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
