HONOURABLE SRI JUSTICE E.V.VENUGOPAL W.P.No.3859 of 2018 ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the relief as follows: "...to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos.2 to 4 in not considering and promoting the petitioner as Inspector of Police (Civil) while promoting several juniors including the 5th respondent as such vide orders issued in R.O.No.860/2017 (Rc.No.1068/E1-122/HR/2017) dated 29-12-2017 by the 4th respondent asbeing arbitrary illegal unjust contrary to the provisions of Rule 6 of T.S. State and Subordinate Service Rules 1996 and in violation of Articles 14 and 16 of the Constitution of India and further be pleased to hold that the petitioner is entitled to be considered and promoted as Inspector of Police (Civil) on par with his batch mates duly protecting his seniority in the promoted post with all consequential benefits such as pay arrears of pay increments etc and to pass..." 2.
Learned counsel for the petitioner submits that in compliance to the order passed by this Court on 23.02.2018, the respondents had passed an order vide R.O.No.319/2018 in Rc.No.1068/E1-122/HR/2017-18, dated 30.04.2018 whereby the writ petitioner has been promoted. He further submits that the said order has been passed without finalizing the seniority and therefore seeks this Court's permission to withdraw the writ petition with a liberty to file a fresh writ petition, if necessary.

Accordingly, granting the liberty, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, shall also stands disposed of.
