HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A. Nos. 175, 214 and 770 of 2018 COMMON JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) Inasmuch as the question of fact and law and the parties in the writ appeals are one and the same and these matters arise out of the common order, these appeals are taken up together for disposal by this common judgment. While W.A.Nos.175 and 214 of 2018 are preferred against the Common Order dated 01.02.2018 in I.A.No.2 of 2018 in W.P.No. 2565 of 2018, W.A.No. 770 of 2018 is preferred against the same order in I.A.Nos.1 and 2 of 2018 in W.P.No. 2565 of 2018 passed by learned Single Judge of this Court.
A perusal of the impugned order discloses that the appellants - Government in W.A.No. 770 of 2018 sought time to file a detailed counter-affidavit, however, without giving opportunity to the Government, the impugned order has been passed. These appeals are bereft of details, such as, when notice was issued in the writ petition and how many opportunities were given to the respondents therein to file counter affidavit. However, without going into that controversy, we deem it appropriate to request the learned Single Judge to decide the main writ petition preferably
SKK,J & AKS,J WAs._175, 214 & 770_2018 within a period of six months from today by giving both the parties an opportunity of being heard.
Accordingly, these writ appeals are disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
