HON'BLE SRI JUSTICE A.RAJASHEKTR REDDY Civil Revision Petition No.795 of 2O2O ORDER:
This Civil Revision Petition is filed against order dated 25.11.2019 in I.A.No.2335 of 2019 in I.A.No.553 of 20i8 in O.S.No.612 of2018.
Learned counsel for the petitioner/ defendant submits that the I.A.No.2335 of 2018 is filed on 22.11.2079 and same was ordered on 25.11.2019, without issuing notice to the petitioner. In this case, it is to be seen that the impugned order is only an exparte interim order and petitioner can approach the trial Court for vacating the same. However, learned counsel for the petitioner submits that the petitioner was set exparte in the suit on 01.03.2019 and he has also filed I.A.No.2162 of 2OI9 for setting aside the same, which is pending.
In view of above facts and circumstances, I am not inclined to entertain this Civil Revision Petition. However, the trial Court is directed to dispose ol I.A.No.2162 of 2Ol9 before deciding I.A.No.2335 of 20L9, in accordance with law.
With the above direction, this Civil Revision Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Civil Revision Petition, shall stand dismissed.
