THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3747 of 2018 ORDER:
The petitioner states that one S.Satyamma was the absolute owner and possessor of agricultural land in Survey No.172/AA admeasuring Acs.9.23 guntas situated at Gangaram Village, Kondapur Mandal, Medak District. She died on 07.11.2003 leaving behind her, her daughter Smt.S.Padmamma as her sole legal heir. The said Padmamma is the first wife of the petitioner's father. She executed a registered Will in favour of the petitioner on 07.07.2012 and she died on 29.04.2015. It is stated that the third respondent, without issuing any notice to the petitioner, passed mutation orders in favour of the fourth respondent by proceedings dated 31.10.2015. Challenging the same, the petitioner preferred an appeal to the second respondent on 16.04.2016. When no action was taken by the second respondent after filing the appeal, the present Writ Petition is filed.
In view of the disposal of this Writ Petition in the following manner, notice to the fourth respondent is dispensed with. Since the appeal filed by the petitioner against the order of the third respondent dated 31.10.2015 is stated to be pending before the second respondent, the second respondent is directed to dispose of the pending appeal in accordance with law, within a period of three months from the date of receipt of a copy of
this order after issuing notice to the fourth respondent and to the petitioner, if it was not already disposed of. If the appeal was already disposed of, a copy of the same shall be furnished to the petitioner.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 07.02.2018 vs
