HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28656 OF 2017 ORDER:
This writ petition is filed challenging the proceedings dated 22.07.2017 issued by the 3rd respondent suspending the petitioner from service pending disciplinary proceedings. Learned counsel for the petitioner submits that the petitioner was appointed as Field Assistant in the 3rd respondent Department and that the allegations made in the impugned order does not pertain to the functions of the Field Assistant, as such, petitioner cannot be suspended on those grounds for which he has no role to play.
On the other hand Sri MSR Chandra Murthy, learned Standing Counsel appearing for the 2nd respondent submits that it is only suspension pending enquiry, and that petitioner will be issued necessary notice indicating the charges. He also submits that the enquiry will be completed within a time frame. Heard Sri G.Narender Reddy, learned counsel for the 4th respondent.
It is to be seen that the suspension is only pending enquiry and it is not a punishment. The truth or otherwise of the allegations in the impugned order can be gone into in the enquiry to be conducted by the respondents. In view of the same, the respondent authorities are directed to complete the enquiry, as per law, within a period of six weeks from the date of receipt of a copy
of this order. In case enquiry is not completed within six weeks, petitioner shall be reinstated into duty.
Accordingly, the writ petition is disposed of. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed ___________________________ A.RAJASHEKER REDDY,J 28-08-2017 avs
