HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.3663 of 2017 ORDER:

The petitioner/ A.5, who along with other accused involved in the offence punishable under Section 8(C) read with 20(b) (1) of NDPS Act, seeks to enlarge him on bail.

2. It is seen that the petitioner moved bail application in Crl.P.No.220 of 2017 before the court of the Special Sessions Judge for NDPS cases cum I Additional Sessions Judge, Warangal and it was dismissed on 03.04.2017 holding that the offence is grave and in as much as commercial quantity of ganja was seized and that the investigation is pending.

3. There are no changed circumstances since then, as the learned Additional Public Prosecutor submits that the investigation is still pending and charge sheet is not yet filed.

4. Having regard to the gravity of the charge and pending investigation, it is not a fit case to grant bail to the petitioner at this stage. The petitioner can renew his bail application after some time, if he is so advised.
