HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39244 OF 2016 ORDER:

This Writ Petition is filed by the petitioners invoking Article 226 of the Constitution of India seeking a direction to the 4th respondent to consider the claim of the petitioners for issuance of pattadar pass books and title deeds in respect of land admeasuring Acs.5.15 guntas in survey No.790, Acs.22.07 guntas in survey No.791, Acs.0.16 guntas in survey No.794 and Acs.21.31 guntas in survey No.795, total admeasuring Acs.81.35 guntas, situated at Uppugal revenue village, Zafargadh Mandal, Warangal District.

Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

A perusal of the material on record would show that on 14.09.2016, the 3rd respondent-Revenue Divisional Officer, Warangal, while disposing of the appeal filed by the petitioners herein directed the 4th respondent-Tahasildar to delete the entries made in favour of the unofficial respondents in the said proceedings and also directed the Tahasildar to initiate action on Form-6(A) filed by the appellants-writ petitioners as per the provisions of A.P. Rights in Land and Pattedar Pass Books Act, 1971. Pursuant thereto, the 4th respondent issued a notice on 07.10.2016 requesting the petitioners to submit Form-6A petition

afresh in accordance with the orders contained in the order of RDO for taking necessary action.

It is submitted by the learned counsel for the petitioners that though the petitioners have submitted a fresh application in form6(A) as directed by the Tahasildar on 17.09.2016, till date no orders are passed thereon.

Learned AGP would submit that the 4th respondent may be directed to consider the application of the petitioners, if the same is still pending consideration, in accordance with law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to consider the application made by the petitioners on 17.09.2016 and pass necessary orders thereon, if the same is still pending consideration, in accordance with law, after hearing the petitioner and the aggrieved party, if any, as early as possible, preferably within a period of eight weeks from the from the date of receipt of a copy of this order.
