THE HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.21994 of 2007 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to issue a writ of mandamus declaring the action of the respondents in issuing the impugned notice dated 20.09.2007 for acquisition of the lands of the petitioner situated in R.S. No.365/ 2 an extent of Acs.2.10 cents, R.S.>No.365/ 3 an extent of Ac.1.16 cents and R.S. No.365/ 4 an extent Ac.1.06 cents (in total Acs.4.32 cents) in Rajavaram, Koyyalagudem Mandal, West Godavari District for the purpose of providing houses under Indiramma Housing Scheme without converting the agricultural lands into residential zone, and in not considering the legal notice of the petitioner dated 10.09.2007, as illegal and arbitrary, and consequently, direct the respondents to drop all further proceedings of acquisition of the petitioner's land.
2. When the matter is taken up for hearing, it is submitted by the learned Government Pleader for Land Acquisition that the cause of action in the writ petition does not survive as the land acquisition proceedings initiated earlier, which is the subject matter in the writ petition, have been withdrawn. The same is reflected in the counter affidavit filed by the 3rd respondent.
3. Recording the same, the writ petition is disposed of. Miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs.
