This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of STi.N.V.ANANTHA KRISHNA, Advocate (being not present) for the Petitioner and of the Public Prosecutor on behalf of the Respondent No.1 and of Sri K.Venkat Reddy, Advocate for the Respondent No.2.

This Criminal Petition is ftled challenging the orders dated 2a.O3.2O16 in Crl.M.P.No.948 of 2016 in Crime No.33 of 2016 of Women Police Station, CCS, DD, Hyderabad, on the file of XIII Additional Chief Metropolitan Magistrate, Narnpa-Ily, Hyderabad, wherein the petition to conduct potency test to the respondent No. 1 therein was allowed.

No representation on behalf of the petitioner, even after posting this matter today under the caption "for dismissal" in the cause list, the very fact that the petitioner has not been attending this Court to prosecute his case shows that the purpose for which this petition is filed may not survive and thereby this matter might have become infructuous.
4, In view of the above facts and circumstances, the Criminal Petition is dismissed for non-prosecution.
As a sequel, pending miscelianeous applications, if any, shall stand closed.
