THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26402 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Municipal Administration and learned Standing Counsel for respondent-Municipality. According to the petitioner, he is the owner of the property bearing door No.18-2-8, Ananda Gajapathi Road, Vizianagaram. The grievance of the petitioner is that the respondents, without issuing any notice and without adhering any due process of law, are high-handedly trying to demolish the constructions of the petitioner.

On the other hand, it is submitted by the learned Government Pleader for Municipal Administration, learned Standing Counsel for respondent-Municipality that if the private property of the petitioner is required for any public purpose, the same would be taken by the respondents strictly adhering to law. The said statement is placed on record.

Having regard to the submissions made by the learned Government Pleader for Municipal Administration, learned Standing Counsel for respondent-Municipality, this Writ Petition is disposed of directing the respondents not to meddle with the private property of the petitioner situated in door No.18-2-8, Ananda Gajapathi Road, Vizianagaram except in accordance with law, if the same is required for public purpose. It is also made

clear if the respondents require the subject properties, they shall follow the due process of law. No costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
