THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.19029 OF 2015 ORDER:
Heard the learned counsel for the petitioner as well as the learned Assistant Solicitor General appearing for the first respondent.
The prayer sought for in the writ petition is as under: " to issue an order writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 and 3 in not executing fresh lease deeds since 29th January, 2010 and not fixing the reasonable rent at the prevailing market rates at which it is paying to the other rented premises as arbitrary, contrary to the principles of natural justice, unconstitutional and consequently direct the respondents to forthwith renew the lease w.e.f. 29-01-2010 and to fix the rent at the prevailing market rates at least which it is paying to the other rented premises like the Commissioners Office Income Tax and pay the arrears of rent with interest at 24%" .
During the course of hearing, it is brought to the notice of this Court that the respondents 2 and 3 have vacated from the premises and as far as payment of rentals is concerned, an application has been filed for appointment of an Arbitrator. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and accordingly, the writ petition is closed. No costs.
