ORDER:

This writ petition is filed for a mandamus to declare the inaction of respondent No.3 Gram Panchayat in mutating the name of petitioner No.1 in its Registers, in respect of house bearing Nos.1-112 & 1-113, College Road/Krosur Road, Amaravathi, as illegal and arbitrary. I have heard Mr.K.Veereshwar, petitioner No.2, who appeared in person and Mr.Ravi Cheemalapati, learned standing counsel for Gram Panchayats (AP) appearing for respondent No.3. The learned standing counsel, on instructions, submitted that respondent No.3 sent notice, dated 20.06.2015, through registered post to petitioner No.1 requesting her to furnish the details of legal representatives of late K.V.K.Bhagavath Sastry and his first wife, who is stated to have died, and that as no response has been received thereto from petitioner No.1, no further action could be taken.

The party-in-person submitted that petitioner No.1, who is his mother, has not received any such notice. However, he has admitted that a copy of the said notice has been enclosed to the counteraffidavit filed by respondent No.3, which was served on him. He has further submitted that he and his mother will approach respondent No.3 with the details sought in the aforesaid notice. He has, however, complained that respondent No.3 has not been showing the minimum courtesy whenever they and other citizens were meeting him. The learned standing counsel submitted that he will instruct respondent No.3 to be courteous and polite, while dealing with the petitioners and other general public, in discharge of his official functions.

In the light of the above submissions, the Writ Petition is disposed of permitting the petitioners to approach respondent No.3 with the details sought in the notice, dated 20.06.

shall take an appropriate decision on the request of the petitioners for mutation and communicate the same to the latter. As a sequel to disposal of the writ petition, W.P.M.P.No.19126 of 2015 filed by the petitioners for interim relief shall stand disposed of as infructuous.
