HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38391 of 2016 ORDER:
The present writ petition is filed by the petitioner seeking to declare the action of the Special Magistrate, Cyberabad, Kukatpally, Court No.1, Ranga Reddy District, in not issuing certified copy of Judgment in CC No.79 of 2014, dated 26.08.2016, as illegal and arbitrary and consequently, direct the learned I-Additional District & Sessions Judge, Ranga Reddy, to register the Crl.Appeal filed by the petitioner and suspend the operation of the Judgment in CC No.798 of 2014, including execution of Non-Bailable Warrants pending against the petitioner.
Heard the learned counsel for the petitioner and perused the material available on record.
After hearing the arguments of the learned counsel for the petitioner and also after perusing the material available on record, this Court is of the view that this writ petition is not maintainable and, therefore, the same is liable to be dismissed. When this Court expressed its opinion about non-maintainability of this writ petition, learned counsel for the petitioner confined his arguments stating that the petitioner is apprehending arrest in view of pendency of NBW against her, and hence, requested this Court to recall the said NBW.
Considering the said submission of the learned counsel for petitioner, without going into the merits of the case, this Court is inclined to pass the following order:
The execution of Non Bailable Warrant, pending against the petitioner, is suspended for a period of two (2) months from the date of receipt of a copy of this order, to enable the petitioner to prefer an appeal against the judgment in CC No.79 of 2014, dated 26.08.2016, before the Court having jurisdiction to entertain the same. Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
