THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24863 of 2007 ORDER:
This writ petition was filed for the following relief: "to pass order or orders or directions particularly in the nature of Writ of Mandamus call for the records and declare the action of the respondents for allotting the lands under Scheme of Indira Kranthi Patakam to the persons belonging to Mala by caste only by denying the same to the petitioners who belonging to Madiga by caste as illegal, arbitrary, contrary to law, much less violation of Articles 24 and 5 of the constitution of India, discriminative in nature and consequently direct the respondents to issue fresh allotments under the Scheme "Indira Kranthi Patakam" to the petitioners on par with others by cancelling any allotments if any made."
There was interim direction granted by this Court on 27.02.2009, as a result of which, the allotment of land under the Scheme of Indira Kranthi Patakam could not take place. Even after nine years no counter affidavit is filed. The erstwhile Andhra Pradesh was bifurcated and a new Government has taken charge in respect of the residual State. The old scheme of Indira Kranthi Patakam is not in vogue.
In the circumstances, this Writ Petition is disposed of giving liberty to respondents to allot the land as per the Scheme formulated by the new Government. It is needless to observe that if the petitioners have any grievance against the Scheme formulated by the new Government, it is open to petitioners to raise objections and submit a representation. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
