THI= HONOURABLE JUSTICE G. SRI DEVI (:RIMINAL PETITION No.1797 of 2021 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused seeking to grant anticipatory bail in the event of her arrest in Cr.No.1 of 2021 on the file of Raidurgam Police Station, Cyberabad District, registered for the offence punishable under Section 38l lPC.

Heard learned counsel for the petitioner/accused, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner/accused would submit that the petitioner has not committed any offence as alleged by the prosecution and that there is a delay of 10 days in lodging the present complaint from the date of occurrence of thefi. He further_submits that the petitioner is working as maid servant since 7 months along with two other maid servants in the house of the de-facto complainant and she has nothing to do with the alleged offence. He further submits that the petitioner was working only on outside of the house of de-facto complainant and she has no access into the house and that during marriage, number of persons had visited the house of the de-facto complainant. He further submits that the entire investigation is completed, except filing of the charge sheet. He also submits that the petitioner is a law abiding citizen and she is ready to abide by any cond tion that may be imposed by this Court in the event of her enlargement orr anticipatory bail.

Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to lhe petitioner.

Having regard to the facts and circumstances and looking into the nature of allegations leveled against the petitioner, without adverting to the merits of the matter, I am inclined to grant anticipatory bail to the petitioner/accused.

The Criminal Petition is accordingly allowed and the petitioner/accused is granted anticipatory bail subject to the following terms and conditions:
(i) The petitioner/accused is directed to surrender before the Station House Officer, Raidurgam Police Station, Cyberabad District, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioner on bail on her executing a personal bond to the tune of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties for the like sum each to his satisfaction. (ii) the petitioner/accused shall cooperate with the investigation and she shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
7, Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
