THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.22309 of 2016 COMMON ORDER: (Per Justice Sanjay Kumar) The grievance of the petitioner in this case was that the State Bank of Hyderabad rejected his proposal for availing the benefit of a One Time Settlement Scheme, under its letters dated 04.01.2016 and 05.01.2016. The ground for rejection of the petitioner's proposal was that the notice sent by the bank to the petitioner on 05.12.2015 under the said One Time Settlement Scheme 2015-16 was by oversight and as the petitioner's account was not eligible for a One Time Settlement in terms of the said Scheme, his application was declared void and the demand draft sent by him was returned.

Perusal of the said One Time Settlement Scheme 2015-16 reflects that as per the cut-off date prescribed thereunder, all non-performing assets as on or before 31.03.2015 alone would be eligible for availing the benefit thereof. In the counter filed by the State Bank of Hyderabad, it is categorically stated that the petitioner's account was classified as a non-performing asset only on 22.05.2015. His account therefore did not qualify for a One Time Settlement under the terms and conditions prescribed under the Scheme.

We therefore find no merit in the petitioner's challenge to the rejection of his proposal under the said One Time Settlement Scheme. The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
