THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4952 OF 2017 ORDER :

Petitioner's grand father worked as Kavalkar in cluster of Tulekurdu Village, Yacharam Mandal, Ranga Reddy District. While in service he died on 21.12.2014. Petitioner being the grand son of the deceased employee, claims appointment on compassionate grounds.

The compassionate appointment is regulated by policy of the Government notified from time to time. When specifically questioned, learned counsel for the petitioner fairly submits that the scheme does not envisage provision of appointment on compassionate grounds to grand son of deceased employee. 3.

When there is no provision for such appointment, no such claim can be made and no direction to provide employment can be granted in the said manner. Compassionate appointment is an exception to normal mode of recruitment. When exception is carved to normal mode of recruitment and when such exception is governed by the scheme, the scheme has to be strictly construed and applied. No person can claim as a matter of right the compassionate appointment, merely because a member of the family was earlier working in government service and died while in service. Thus, the claim made by the petitioner is not maintainable and no direction to consider the request or representation can be granted. Hence, the Writ Petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
