This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri K. Ramachandra, Advocate for the Petitioner and of Sri K.Madhavi, learned Asst Public Prosecutor on behalf of the Respondent No.'1 and Sri Vijay Bhaskar Kakunoor .8, learned counsel for unofficial appeared for the Respondent No.2. ORDER
This Criminal Petition is filed by the petitioner-accused seeking to quash the proceedings against him in C.C.No.269 of 2019 pending on the file of learned Additional Junior Civil Judge, Sanga Reddy, registered for the offences under Sections 341, 323,504 of the lndian Penal Code (for short 'lPC')
02. Heard Sri K. Ramachandra, learned counsel for petitioner and Sri Vijay Bhaskar Kakunoor B. learned counsel for unofficial respondent No.2 as well as Smt.S.lVladhavi, learned Assistant Public Prosecutor for the State.
03. Brief facts of the case are that the houses of the complainant and accused are adjacent and on 24.0'l .201g at about 2130 hours when the accused taking photographs of the vehicle of the complainant which was parked on the road, the wife and mother of the complainant questioned the acts of the accused, for which, the accused bet the complainant and his mother of the complainant by abusing them in filthy language. Due to which, they received injuries.
04. Learned counsel for petitioner submitted that the petitioner is nothing to do with the alleged offences. The present criminal case was filed as a counter-blast to the Crime No.28 of 20'19 registered for the offences under Sections 324, 323 read with 34 of the IPC wherein the petitioner herein is the complainant and respondent No.2 herein is the accused. There was unexplained delay of B days in registering the complaint. Therefore, he prayed this Court to quash the proceedings against petitioner-accused by allowing this Criminal Petition. Further, it is submitted that the learned trial Court had commenced the trial and the same is under progress.

On the other hand, learned Additional Public Prosecutor appearing for the State as well as learned counsel for respondent No.2 contended that it is not a fit case to quash the proceedings against petitioner at this juncture and the matter is to be decided after conducting trial by the Court below and prayed to dismiss this Criminal Petition.
06. On perusal of the entire record, there are triable issues and the truth or otherwise of the allegations made against petitioner can be decided only after conducting full-fledged trial.
Learned counser for both sides submitted that the trial is in active progress before the learned trial Court. Therefore, this Court without going into the merits and demerits of the case, is of the considered opinion that there are no grounds to quash the criminal proceedings against the petitioner_accused. Further, the learned trial Court shall not be influenced by any of the observations made in this Order, in any manner and shall dispose of the main case as expeditiously as possible, in accordance with law.
