THE HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION No.5342 OF 2016 ORDER:

The Civil Revision Petition is directed against the docket order, dated 29.8.2016, in I.A.No.1340 of 2016 in O.S.No.201 of 2016 on the file of the Senior Civil Judge, Pithapuram, East Godavari District, whereunder and whereby, petition filed by respondent No.1 herein/plaintiff under Order XXXIX Rules 1 and 2 C.P.C. to pass an ad interim injunction in her favour and against the defendants was ordered by granting ad-interim injunction restraining the defendants and their men from interfering with the peaceful possession and enjoyment of the plaint schedule property and her construction work till 9.9.2016.

Heard the learned counsel for the petitioner. 3.

Respondent No.1/plaintiff filed O.S.No.201 of 2016 on the file of the Senior Civil Judge, Pithapuram, East Godavari District for permanent injunction. She filed I.A.No.1340 of 2016 in O.S.No.201 of 2016 for ad-interim injunction and the same was ordered on 29.8.2016. Challenging the same, defendant No.3 filed the present revision petition.

Considering all the facts and circumstances of the case, the trial Court is directed to dispose of I.A.No.1340 of 2016 in O.S.No.201 of 2016 on the file of the Senior Civil Judge, Pithapuram, East Godavari District, after hearing both parties, as expeditiously as possible preferably, within a period of three (3) months from the date of receipt of a copy of this order. The

impugned order of ad-interim injunction granted by the trial Court shall stand suspended till the disposal of I.A.No.1340 of 2016. 5.

Accordingly, the Civil Revision Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Civil Revision Petition shall stand closed.
