THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.17763 of 2008 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) While Sri Arifullah, learned counsel for the petitioner, states that the impugned order is bereft of reasons, the learned Government Pleader for Transport is unable to show any reasons having been assigned in support of the impugned order.
The impugned order is, therefore, set aside. The licensing authority shall pass a reasoned order afresh in accordance with law, after giving the petitioner an opportunity of a personal hearing, within two months from the date of receipt of a copy of this order. Till such orders are passed, the amount paid by the petitioner, pursuant to the interim order passed by this Court earlier, shall be kept in deposit with the respondent and shall be subject to the orders which shall be passed afresh by the licensing authority.
The Writ Petition stands disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
