THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2442 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-3 in C.C.No.1222 of 2013 pending on the file of VIII Metropolitan Magistrate, Cyberabad, Rajendranagar, arising out of Crime No.28 of 2013 of Shamshabad Police Station, Cyberabad District for the offences punishable under Sections 336, 420, 406 IPC and Section 7 (1) of Essential Commodities Act and order 3 (1) (a) (b), 4 (1) of LPG Regulation of Supply and Distribution Order, 2000. Heard the learned counsel for the petitioner/A-3 and the learned Public Prosecutor and perused the material available on record.

The main contention of the learned counsel for the petitioner/ A-3 is that the petitioner was falsely implicated in the above crime on a suspicious ground and he is no way connected with the alleged offences. Whether the petitioner has committed the alleged offences or not has to be necessarily ascertained by the Court during the course of trial and the same cannot be determined at this stage.

Having regard to the facts and circumstances of the case and in view of the nature of offences alleged against the petitioner, this Court is not inclined to interfere with the proceedings against the petitioner/A-3 at this stage. In any event, considering the request of the petitioner/A-3, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is essentially required by the Court including for the

examination under Section 313 Cr.P.C. and the petitioner shall be properly represented by his counsel.

With the above direction, the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
