THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22661 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondents in not taking any action to prevent the grab of the property of the Gnanananda Ashram & Ramananda Ashram, 55-1-26/4, GNR Sadhu Mutt, Venkojipalem, Visakhapatnam by antisocial elements and also not taking any action against the persons, who occupied the certain portion of the land of the Ashram located in Sy.No.19/1 and 19/2 of Venkojipalem Village, Visakhapatnam and non-implementation of G.O.Ms.No.66, dt.08.02.2017 is illegal, arbitrary, unconstitutional and unwarranted and consequently direct the respondents to take action immediately to implement G.O.Ms.No.66 Revenue (Endts.II) Department dt.08.02.2017, and take action against the persons, who are taking steps to grab the lands if Ashram."

The main grievance of the petitioner is that some antisocial elements are trying to grab the property of Gnanananda Ashram & Ramananda Ashram and some persons already encroached into the land of the Ashram located in Sy.Nos.19/1 and 19/2 of Venkojipalem Village, Visakhapatnam and that though several representations were made to the respondents, no action is taken. 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and in view of the fact that the respondents have to take necessary action

against the persons concerned if they receive any complaint regarding encroachment of the properties belonging to Ashrams, without going into the merits of the case, the Writ Petition is disposed of directing the respondents to take appropriate action against the persons, who are trying to grab the property of Gnanananda Ashram & Ramananda Ashram and also who occupied the land of the said Ashram illegally, in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
