HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.4663 of 2020 ORDER :
This writ petition is filed seeking Mandamus to declare the action of respondent Nos.1 to 4 in mutating the subject properties, which are in the name of one Mr. P. Balaiah, in spite of receiving objections filed by the petitioner, as arbitrary and illegal, and consequently sought a direction to respondent Nos.1 to 4 to restore the name of Mr. P. Balaiah as owner of the subject lands without entertaining any application from respondent No.5 till disposal of O.S.No.84 of 2017 pending on the file of XII Additional Chief Judge, City Civil Court, Secunderabad.
Heard learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondent Nos.1 to 4.
Admittedly, the petitioner has filed O.S.No.84 of 2017 on the file of XII Additional Chief Judge, City Civil Court, Secunderabad, for partition of the suit schedule property. He also filed I.A.No.1039 of 2018 in O.S.No.84 of 2017 seeking similar relief. During the pendency of the said application, instead of pursuing his remedies in the said suit, the petitioner has filed the present writ petition, which cannot be entertained.
ARR,J W.P.No.4663 of 2020 In view of the same, this writ petition is disposed of granting liberty to the petitioner to pursue his remedies in the suit O.S.No.84 of 2017 pending before XII Additional Chief Judge, City Civil Court, Secunderabad. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
