THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8271 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 to A.5 seeking bail in crime No.171 of 2015 on the file of P.S., Alipiri, Chittoor District, registered for the offence under Section 302 read with 34 IPC. Heard and perused.

The allegation against the petitioners herein is that they have stabbed the deceased and when the deceased was shifted to SVIMS Hospital, the Medical Officer examined the deceased and declared dead.

This Court is of the view that the present occurrence is in retaliation of the earlier attack on the petitioner by the deceased concerned and as such, this Court is not inclined to grant bail to the petitioners at this stage. The petitioners are given liberty to move bail application after filing of charge sheet.
