HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL PETITION No.109 of 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., by the petitioners/A.1 and A.2 to quash the proceedings in Crime No.253 of 2010 on the file of Central Crime Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420 and 506 IPC.

Learned counsel for the petitioners submits that the police after completion of investigation in the above crime, filed charge sheet, therefore, the cause in this petition does not survive for further adjudication and sought liberty to challenge the charge sheet. 3.

Per contra, learned counsel for the second respondent submits that the petitioners have dragged on the proceedings for several years after obtaining stay from this Court, therefore, costs may be imposed on the petitioners. He further submits that a direction may be given to the trial Court to dispose of the Calendar Case, expeditiously. 4.

Since the police have filed charge sheet only six months back the contention of learned counsel for the second respondent that the petitioners have dragged on the proceedings does not arise. Therefore, I do not see any valid ground to impose costs on the petitioners.

Accordingly, the Criminal Petition is disposed of. However, the trial Court is directed to dispose of Calendar Case, as expeditiously as possible. Miscellaneous petitions, if any, pending in this petition shall stand closed.
