THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4581 of 2020 ORDER:
Petitioners assert that they are the owners of the land to an extent of Acs.3.15 guntas and Acs.4.19 guntas in Survey Nos.121 and 217 respectively, situated at Mirzaguda Village, Janwada Revenue Village, Shankarpally Mandal, Ranga Reddy District, part of their land was used for the purpose of road widening and as on date, no acquisition proceedings have been initiated. Their grievance is that as far back as on 23.12.2019, they submitted representations to the respondent authorities for payment of compensation, as, their land was affected in road widening and to take action against the Officers of the Gram Panchayat for their illegal action, but, the respondents did not respond to the same. Hence, they filed the present Writ Petition.
Heard learned counsel for the petitioners.
Learned Government Pleader for Land Acquisition appearing for respondent Nos.1 to 3 and learned Standing Counsel for Mirzaguda Gram Panchayat appearing for respondent No.4 submit that objections of the petitioners would be considered and as the road has already been laid, if the
CKR, J W.P.No.4581 of 2020 objections of the petitioners were found correct, necessary proceedings would be initiated.
It is to be noted that acquisition of the property without payment of compensation would be violative of Article 300-A of the Constitution of India.
In those circumstances, this Writ Petition is disposed of with the direction to respondent No.2 - District Collector, Ranga Reddy, to consider the representations of the petitioners and initiate necessary proceedings for acquisition of the subject land and for ascertainment of compensation. This entire exercise shall be completed within a period of six (6) weeks from the date of receipt of a copy of this order.
Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
