Heard the learned Assistant Government Pleader for Home appearing for respondents 1 and 2.
The petitioner complains against the 1st respondent in interfering with civil dispute concerning building bearing Door No.3695-149/A, Babuji Nagar, Kancharapalem, Visakhapatnam and threatening the petitioner to hand over the premises to respondents 3 and 4 as illegal and unconstitutional.
The petitioner complains against the inordinate delay or no investigation into First Information Report in Crime No.709 of 2013 registered based on the complaint given by the petitioner against respondents 3 and 4.
The learned Assistant Government Pleader basing on written instructions dated 19.10.2013 received from Sub-Inspector of Police, Kancharapalem Police Station, Visakhapatnam, submits that on the private complaint filed by the 3rd respondent, Crime No.518 of 2013 under Section 420 IPC and Section 156(3) Cr.P.C., was registered on 14.07.2013. Likewise on the complaint of the petitioner, crime No.709 of 2013 was registered on 30.09.2013 under Sections 448, 427, 379 read with 34 IPC against the 3rd respondent. The
SVB,J WP_29739_2013 1st respondent registered the crimes and investigating into the allegations made in respective complaints. The statement of the 1st respondent is placed on record, which shows that the 1st respondent except registering the crimes referred to above, did not pressurise the petitioner to hand over possession of building bearing Door No.36-95-149/A, Babuji Nagar, Kancherlapalem, Visakhapatnam or interfere in the civil dispute between the petitioner and respondents 3 and 4.
Accordingly, the Writ Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________ JUSTI CE S.V.BHATT Date:19.04.2017 INL
