THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.1614 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C to enlarge the petitioners/A.6 to A.10 on bail in the event of their arrest in connection with Crime No.6 of 2017 of Kambadur Town Police Station, Anantapuram District, registered for the offences punishable under Sections 354 (A) and 324 read with 34 IPC and Section 3 (1)(r), 3 (1)(s), 3(1) (za) (A) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. 2.

After arguing the matter for a while, learned counsel for the petitioners requested the Court to permit the petitioners to surrender before the Special Judge for Trial of offences under Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act and file an application under Section 439 Cr.P.C. for grant of bail and on such surrender, the learned Special Judge may be directed to decide the application on the same day.

Acceding to the request of learned counsel for the petitioners, without touching the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Special Judge for Trial of cases under Scheduled Castes and the Scheduled Tribes (POA) Act and on such surrender, the learned Special Judge is requested to decide the application for bail, if any, filed on the same day, after serving notice on the learned Public Prosecutor.
