This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused No.2 in Crime No.22 of 2026 before the Sircilla Town Police Station, Rajanna Sircilla District, registered for the offence punishable under Sections 318(4), 316(5), 329(3), 324(3), 126(2), 351(2), 308(6) r/w 3(5) of BNS.

The brief facts of the case are that the complainant alleged that accused Nos.1 and 2 conspired with others to unlawfully grab his land measuring 423.24 sq. yards at Kummari Galli, Sircilla. It is stated that A1 and A2 created a forged document dated 18‐03‐2012, which was registered by A3, the then Sub‐Registrar, as a Gift Deed in favour of A2. Subsequently, A4 mortgaged the property relying on the said deed. Thereafter, A1 and A2 allegedly trespassed into the land, demolished the compound wall, restrained the complainant, and threatened him with dire consequences. Hence, the FIR was lodged.

Heard Sri Y.Shashidhar Reddy, learned counsel for petitioner, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that petitioner/Accused No.2 is a housewife with no role in the alleged offences. Except for vague and general allegations, no specific overt act is attributed to her. The entire

allegations revolve around A1, and the petitioner has been falsely implicated only to harass her. He contended that none of the ingredients of the offences under the cited provisions of BNS are attracted against her. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners, and contended that the petitioner is named in the FIR and the Gift Deed was executed in her favour, hence, her involvement cannot be ruled out. Considering the gravity of allegations, anticipatory bail was earlier rejected, and custodial interrogation may be necessary, he prayed the Court to dismiss the criminal petition. 6.

Having regard to the rival submissions and material on record, it is noted that the petitioner is the wife of A1. The allegations primarily concern A1, who executed the Gift Deed in favour of the petitioner and later obtained a loan from Sri Ram Finance. Except for the execution of the

document in her name, no active participation of the petitioner in the alleged offences is made out. A1 has already been arrested and released on bail. Therefore, considering the circumstances of the case in entirety, this Court deems it fit to grant pre-arrest bail to the petitioners subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Sircilla Town Police Station, Rajanna Sircilla District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
