HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.859 of 2017 ORDER:

Petitioner claiming to be the resident of Kamalkote Gram Panchayat alleges in this writ petition that illegal sand excavation is taking place by using heavy machinery and being transported from Godavari River and in spite of complaints being filed, no action is taken.

When the matter is taken up for consideration, learned Government Pleader submits that State Government has issued notification vide G.O.Ms.No.9, Industries and Commerce (Mines.I) Department, dated 24.02.2016. By this notification, Telangana State Sand Mining Rules, 2015 were amended. The Rules constituted the Complaint Adjudicating Committee at the district level comprising of Collector and District Magistrate as Chairman, Superintendent of Police and the Deputy Director of Mines and Geology of the Region as Members. He submits that petitioner can as well complain to the said Committee. Since petitioner already submitted representation to the District Collector on 31.12.

2016, the District Collector shall place this complaint of the petitioner before the Complaint Adjudicating Committee and shall examine whether alleged illegal extraction of sand by using heavy machinery is valid and to take appropriate further course of action in accordance with the Government policy. The decision shall be taken by the Complainant Adjudicating Committee within a period of three weeks from the date of receipt of copy of this order.

The writ petition is disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
